An important development has emerged regarding the projects of Supertech Limited, a company that has been facing challenges in the Real estate sector for quite some time. The Supreme Court of India has issued clear directives that a decision be taken quickly regarding the remaining 14 housing projects, so as to clear the way for their completion and provide relief to the hundreds of buyers who are waiting for their homes.
The Court’s focus now is that the wait must end and the project be completed
NCLAT has been directed to make a fast decision regarding the merger and takeovers of these projects. The court’s primary objective is to ensure the speedy completion of construction work and to finally resolve all the problems of those who have been waiting for their homes for years.
The court has further clarified that, in this process, not only builders or agencies but every stakeholder will be given a hearing, whether it be the land owning authorities, such as the Greater Noida Authority, or the local farmers upon whose land these projects have been developed.
A major decision was taken previously as well
Last year, in February 2025, the Supreme Court took another major decision. The court approved the NCLAT order under which 16 out of 30 stalled projects were assigned to the government PSU NBCC (India) Limited for completion.
Consequently, uncertainty persists regarding the future of the remaining 14 projects. For this reason, the court has asked the NCLAT to take up the matter for hearing by 20 April and give a final decision quickly.
The court understood the Concerns of Homebuyers
Supreme Court bench in which Chief Justice Suryakant and Justice Joymalya Bagchi were included. They acknowledge that the buyers’ concerns are genuine. Several projects remain in ‘Limbo’, with construction having stalled and no clear timelines provided.
Work is expected to commence on those projects that were handed over to the NBCC. It is precisely this contrast that has caused the buyers to become even more anxious.
The Court monitored the Framework
The court also made an observation that all the projects that are completed, partially finished, or completely stopped should be managed under a single unified Framework.
This shows that a Common authority could be established to oversee all those projects, thereby enhancing transparency and minimising delays.
The Court will have to determine whether the remaining 14 projects can be handed over to the other agency, like those that were previously transferred to the NBCC.
Complications in the Insolvency Process
Another complication in the Supertech case is that the company’s insolvency resolution professional (IRP) has been suspended due to misconduct. The resolution process has slowed down even more.
In this situation, the court was compelled to intervene to ensure that work on the project does not come to a stop and that buyers do not face any further delay.
The use of Article 142
The Supreme Court had previously used its special power under Article 142 of the Constitution of India. Through these powers, the court ensured that NBCC was permitted to handle the project without any legal impediments.
The court has stated that no tribunal or High Court should pass any order that would stop the construction work.
How many people are affected?
According to the reports, Supertech booked approximately 51000 flats between 2010 and 2012, of which around 27000 homebuyers are still waiting for their homes.
In some cases, this delay has already stretched to between 10 and 15 years. This is a situation that is financially or emotionally stressful for the buyers
Execution plan of NBCC
A detailed plan has been submitted by the NBCC, which had been divided into three phases:
Phase 1: Eco Village and Cape Town-like major projects in Noida and Greater Noida
Phase 2: Yamuna Expressway and Meerut projects
Phase 3: Gurugram, Dehradun, and Bengaluru’s projects
NCLAT gives direction to NBCC to commence awarding contracts by March 2025, and for the construction work to officially start in May 2025.
How did insolvency start?
Supertech’s financial crisis came to the fore on a major scale in 2021, when the Union Bank of India initiated insolvency proceedings against the company.
The band had claimed over Rs. 431 crore, following which the matter was referred to the Insolvency Tribunal. Since then, the future of the project has remained uncertain.

Now, all eyes are on the hearing schedule for April 24. If the NCLAT reaches a decision swiftly and the remaining 14 projects are also handed over to a capable agency, 1000 of buyers could finally receive relief.
